Overview of ITC Section 337 Investigations
The United States International Trade Commission conducts ITC Section 337 investigations under section 337 of the Tariff Act of 1930 (19 U.S.C 1337). These investigations involve allegations of unfair competition in the sale for importation, the importation of products into, and/or their subsequent sale in, the United States, that infringe a U.S. patent, copyright, registered trademark, or mask work as well as other unfair methods of competition and unfair acts. Section 337 investigations offer IP rights holders a powerful remedy—an exclusion order enforced by U.S. Customs and Border Protection (“Customs”) blocking infringing products from entering the United States.
